1. Introduction
 
These Terms & Conditions (“Terms”) govern the use of this website and any engagement with David Prado Photography. By using the site or booking a session, you agree to these Terms.
These Terms cover general website use and inquiries. All booked sessions are also governed by a separate written photography agreement provided upon booking.
 
2. Booking & Retainer
 
A non-refundable retainer of $1,000 (or as otherwise specified) is required to secure your date for weddings or events. Other session types may require smaller retainers.
The remaining balance is due according to your payment plan or before your scheduled session date.
 
3. Cancellations & Rescheduling
 
Cancellations made by the client result in forfeiture of the retainer.
Sessions may be rescheduled with at least 7 days’ notice for standard sessions or 30 days’ notice for weddings, subject to availability.
If the photographer must cancel due to illness, emergency, or unforeseen event, all payments will be refunded or credited toward a future session.
 
4. Payments
 
All payments must be made through approved online methods.
Late payments may delay gallery delivery. Returned payments or chargebacks will incur additional fees.
 
5. Copyright & Usage
 
All photographs remain the intellectual property of David Prado Photography under U.S. Copyright Law.
Clients receive a personal use license, allowing them to print, share, and post images for personal, non-commercial purposes.
Commercial use, resale, or alteration of images without written permission is prohibited.
 
6. Model Release
 
By booking a session, you grant permission for your images to be used for marketing, portfolio, and promotional purposes unless you opt out in writing before your session.
 
7. Gallery Delivery
 
Gallery delivery timelines vary by session type.

  • Weddings: typically 3–4 weeks

  • Portraits, engagements, or family sessions: typically 1–2 weeks
    Timelines may vary during busy seasons or due to unforeseen events. Galleries are hosted online for one year unless otherwise stated.
     

8. Liability
 
We take every reasonable step to ensure professional service. However, in the unlikely event of loss, damage, or system failure, liability is limited to the total amount paid for services rendered.
 
9. Client Responsibilities
 
Clients agree to arrive on time, cooperate during the session, and provide accurate information. Missed coverage or unsatisfactory results due to lack of cooperation, delays, or misinformation are not the photographer’s responsibility.
 
10. Force Majeure
 
Neither party is liable for failure to perform due to events beyond reasonable control, including illness, weather, natural disasters, or government actions.
 
11. Amendments
 
We may modify these Terms at any time without prior notice. Updates will be reflected by the “Last Updated” date above. Continued use of our website or services indicates acceptance of any revised Terms.
 
12. Governing Law
 
These Terms are governed by the laws of the State of Utah, and any disputes will be resolved in Utah County courts.
